Lensi Photography Terms and Conditions
Contact person: This shall be the person who made the booking
Address: This shall be the address the shoot will take place as provided by the client. Please provide full address with post code
Set Up Time and Details: This shall be the agreed set up time, as agreed via email or listed on invoice.
Deposit: 50% deposit secures the booking, the date is then excluded from the calendar and we may do preliminary work such as booking studios, sourcing accessories, storyboarding the shoot etc. The remaining 50% is due 1 week before the shoot.
For shoots that will take place within the same week full payment is due.
Quotes are valid for 30 days
Any additional services to those outlined in the quote will be charged. For example if this is an hour shoot and it spills over to 1hour and a half. If it is booked as a headshot shoot and other shots are asked to be included.
TERMS AND CONDITIONS
Lensi Photography has provided the services detailed (quote or commission confirmation) to the client to whom the invoice is addressed.
CONFIRMATION – Payment of a deposit / confirmation email / charity letter serves as agreement of terms and conditions and a confirmed booking. Please inform Lensi Photography in writing (email) of any disputes to this agreement before the event.
RESERVATION – Upon your acceptance and deposit, “LENSI PHOTOGRAPHY” will reserve the time and date agreed upon, and will not make other reservations for that time and date, that cannot be fulfilled by the company. For this reason, the Reservation Deposit and Booking Fee of 50% is non-refundable, even if the date is changed or cancelled for any reason; including acts of God, fire, strike and/or extreme weather. Some preliminary work will take place before the date of the shoot as highlighted above
In the event of a national lockdown, pandemic / epidemic that restricts both or either parties from fulfilling the contract. The booking will be rescheduled free of charge to a date within 1 year of the original booking.
The Reservation Deposit is to be paid at time of accepting the contract. The Reservation Deposit is applied towards the contracted photography package. THE CLIENT understands and agrees that the entire amount owed for the photography package described in the contract is due 1 week before the event. All deposits / booking fees are non-refundable.
Events cancelled after a booking is confirmed, are subject to a minimum £200 cancellation fee or the booking deposit fee if that applies to your type of booking.The booking may be fulfilled by any Lensi Staff.
Any queries the client may have concerning this invoice should be addressed to firstname.lastname@example.org within 14 days of the date on this invoice, otherwise this invoice will be regarded as agreed by the client.
The client shall be responsible for making Denise Davina Maxwell of Lensi Photography aware of all internal company procedures regarding invoicing within 14 days of the date of the invoice or commission. We use an online invoicing system. For invoices that are required in a particular format different to ours or a hard copy. We will add a £25 administration charge to cover this.
LIMIT OF LIABILITY: In the unlikely event of severe medical, natural, or other emergencies, it may be necessary to retain an alternative photographer. “LENSI PHOTOGRAPHY” will make every effort to secure a replacement photographer able and/or willing to provide a similar package as chosen in this contract at the same/similar cost.
If such a situation should occur and a suitable replacement is not found, responsibility and liability is limited to the return of all payments received for the event package.
“LENSI PHOTOGRAPHY” takes the utmost care with respect to exposure, transportation and processing of photographs; including using professional grade equipment and professional grade backup equipment. However, in the unlikely event of all of THE CLIENT’S photographs being lost, stolen or destroyed for reasons within or beyond “LENSI PHOTOGRAPHY” control, the latter’s liability is limited to the return of all payments received for the event package. The limit of liability shall not exceed the contract price stated herein. The limit of liability for a partial loss of originals shall be a prorated amount of the exposures lost based on the percentage of total number of originals.
Payment of invoices should be made in full within 30 days of the date of which the invoice is presented
Once a commission is confirmed meetings and admin relating to that commission shall be billed at £75 /p/h.
The Client will make all arrangements for authorisation, property releases and any other arrangements to enable photography to take place. The inability for photography to take place because of a failure on this, will not be the liability of Lensi.
NOTE – following the implementation of the 1998 Late Payment of Commercial Debt (Interest) Act, overdue payments will attract a charge of £50 on the 31st day after invoice has been issued for invoices of less than £500 (£75 for invoices of more), and additional £50 (£75 for invoices of more) on the 45 days, an additional £50 (£75 for invoices of more) on the 60th day.
Once fees are outstanding for 60 days from the date of issue, Denise Maxwell of Lensi Photography reserves the right to pass the invoice to an outside agency for collection, without any further notification being given to the client, and will seek to recover any costs incurred in this and/or subsequent legal action from the client concerned. Alternatively Lensi will continue to add charges every 15 days that payments remain outstanding before passing the invoice to a Debt Collection Agency.
COPYRIGHT, LICENSES and RIGHTS
In line with the Copyright, Design and Patents Act 1988, all images are the copyright of Denise Davina Maxwell of Lensi Photography. Copyright is the intellectual property right that authors have in the work they have created. “Authors” in this case refers to the photographer. Images are licensed to the client for use as specified, and by the named client only. The Client may not sell, distribute or otherwise sub-license any images without written permission from Denise Maxwell of Lensi Photography, who is to be identified as the author of the images. Lensi Photography maintains the right to use these images for marketing and promotion, which may include but is not limited to social media such as instagram and facebook, websites, news articles, marketing videos, leaflets, albums etc.
All moral rights are asserted.
In the case of commissioned work, payment is not conditional on publication.
No rights are assigned until invoices are paid in full. Usages outside of the terms of the licence will result in further applicable fees for the use of images, the client shall remain a bailee only until payment is made. Full copyright can be purchased for a minimum of four times the amount of a licensed image/s in line with the National Union of Journalists guidelines. Denise Maxwell of Lensi Photography is a member of the National Union of Journalists.
Denise Maxwell of Lensi Photography is a sole trader and is not vat registered, payments should be made in the name of Denise Maxwell by BACS to account.

Payment is DUE WITHIN 30 days of shoot for corporate shoots. All payments due before shoot takes places for personal shoots.
All images are supplied with various Licence to reproduce for the commissioning person / organisation / company. LICENCE : to reproduce by the client for their marketing, sales and promotion material for the client for the event and their social media platforms. Any further use by third party organisations, companies and people will need to be relicensed by the copyright holder at the appropriate fees. Any unauthorised of these Images shall entitle Licensor to exercise all rights and remedies under applicable laws
Credit Line and Copyright Notice: For editorial uses, you shall include a copyright notice and photo credit adjacent to each Image (in the format: “© Lensi Photography” or as specified within any other agreement, with each publicly distributed Image of Licensed Material. Receiving credit is a material aspect of the Agreement for Licensor, and in editorial uses of Images or any Licensed Material, you agree to pay triple the Invoice amount if you do not provide such credit and copyright notice. For commercial uses, you shall include the credit described above when customary and appropriate.
If a commissioned job /date is cancelled the following fees apply, as the date has already been set aside and other work turned away to fit in this commission.

DIGITAL IMAGES – Images shall be provided electronically via a download link, unless otherwise agreed beforehand. Providing the images in any other format may require further time and thus will incur additional fees. Clients will be sent a link to download images and should download within one week of receiving this link. Images should then be stored for future use by the client. Lensi Photography will keep these images for a limited period before they are deleted.
Failure to save these images / failure to download these images by the client / failure to download within the time period that results / loss of the images is the clients responsibility.
If images are lost or not saved for these reasons, an additional admin fee will be required to resend.
Images over 6 months old that have not been downloaded may have been deleted.
PRINTED IMAGES – Print packages will be outlined at the time of order and delivered directly to the client, unless stated otherwise.
The client will be responsible for any covid tests needed for the shoot to take place. Lensi Photography will shoot in line with guidelines and exemptions. Should the shoot need to be rescheduled because of a positive test, Lensi Photography will reschedule the shoot at a mutually convenient time within one month for no further fee. A cancellation outright will incur a cancellation fee.
If a further lockdown occurs that prevents the shoot from happening, once booked, the shoot will be arranged for a mutually convenient time, once lockdown is lifted. Or the amount can be credited against another service. An outright cancellation will incur the contractual cancellation fee.
The turnaround for the supply of roaming images is approximately 3 days – 2 weeks, depending upon seasonal workload.
The turnaround of photoshoot print images will be between 1 – 2 weeks for final viewing and up to 4 weeks for print delivery.
An express 24 hour editing service can be provided (where possible) prices vary depending on the type of shoot.
All images will be edited to the standard Lensi editing. Advanced edited shall include but is not limited to : editing out pieces of clothes, editing blemishes out of a bulk of photos (such as at a wedding shoot), editing people out or people into photos, editing out items that could have been taken off to prevent this, editing out straps and other items that could have been worn or tucked in to prevent them showing, changing backgrounds etc. This is the clients responsibility to ensure the right people are in or out of the photos, and the right clothes are worn to prevent this, or to question the environment / background the photo is taken in.. Advanced editing of this type is done externally and will be charged at £60 per hour. It may extend the turnaround time
Editing will also be in the style delivered by Lensi. Please use the Lensi Portfolio as examples of this. We cannot edit in another style. Editing in another style can be outsourced at a cost of £50 per hour. All images will be delivered as edited Jpeg files.
A confirmed commission / delivery of our service to you / delivery of images / order serves as acceptance of our terms and conditions .
ABUSE, THREATENING BEHAVIOUR AND MISCONDUCT “Lensi” will not tolerate verbally or physically abusive behaviour, nor will it share its time or compete with guest photographers for the attention of the subjects. Unchecked guest conduct that interferes with photography may seriously affect the quality of the photographs taken and increase the number of times photos must be re-taken. If THE CLIENT is unable to control the conduct of their guests / staff or people who accompany them to shoots, resulting in an unacceptable degree of misconduct, or if the conduct of any of their guests damages the equipment of the photographer, it will result in the early or immediate departure of the photographer. THE CLIENT understands that in such an event, no refunds will be granted.
